Directing the Iraqi government to activate Article 140.. Will it renew Baghdad's differences with Kurdistan?

link

Last Monday, the announcement by the Iraqi Minister of Justice, Khaled Shawani, of the approval of the Iraqi Prime Minister, Muhammad Shia'a al-Sudani, to reconfigure the Supreme Committee to activate Article 140 of the constitution - related to disputed areas between the federal governments and the Kurdistan region - sparked widespread controversy in the political and popular circles.

The committee is scheduled to start its work within 10 days, according to Shawani (a leader in the Patriotic Union of Kurdistan) in a post on his Facebook page, and indicated that the agreement on reactivating the committee comes within the government program for the Sudanese.

This came after a meeting held by the "State Administration" coalition, which includes most of the political forces participating in the government, at the house of the President of the Patriotic Union of Kurdistan, Pavel Talabani, in Baghdad, in the presence of the heads of the Sudanese government and parliament, Muhammad al-Halbousi, and the heads of political blocs and parties.

In addition, the decision to form the committee - which was suspended in 2014 - revived fears that it would cause a rift in the political situation again between Baghdad and the region, especially as it is a central point of contention between the two parties due to the failure to reach solutions during the period of successive governments after the US invasion, as well as what could be It may result from interactions at the security level in the disputed areas, especially Kirkuk Governorate (north of Baghdad).

But Benkin Rikani - a member of Parliament for the Kurdistan Democratic Party and former Minister of Construction and Housing - believes that the implementation of Article 140 will have great positive repercussions, such as the Kurds' feeling that they are first-class citizens, and will also contribute to achieving lost security in the disputed areas.

He assured Al-Jazeera Net that the agreement on reactivating the committee concerned with forming the article was within the agreement of all the signatory forces on the document establishing the State Administration Coalition during the political understandings about forming the government, and that failure to adhere to these pledges makes each political party absolved of its obligations, which threatens the future of the government.

he State Administration Coalition is a political alliance that was formed last September from the coordination framework (Shiite forces other than the Sadrist movement), and all the Sunni forces represented by the "Resolve" and "Sovereignty" coalitions, in addition to the two Kurdish parties, the Patriotic Union of Kurdistan and the Democratic Union, and the Babylonian Movement on behalf of the Christians. .

Rikani believed that re-forming the Article 140 Committee, compensating those included in it among the Kurdish victims and other affected people, and returning the residents who were transferred by the former regime to their original areas, would achieve stability, especially in Kirkuk.

He pointed out that the agreement this time took place through understandings to form the Sudanese government, unlike all previous agreements, as it included a document signed by all parties.

An eye on Kirkuk

On the other hand, Jawad al-Ghazali, a member of the House of Representatives for the State of Law bloc, believes that the pressures from the Kurdish side regarding the activation of Article 140 approved in the 2005 constitution aim to seize Kirkuk, which contains great wealth.

In an interview with Al-Jazeera Net, Al-Ghazali indicated that the activation of this article without taking into account the legal and constitutional articles and the referendum on the popular Iraqi position of the majority will lead to very big problems, which may lead to a "civil war", noting that the governments of Baghdad and the region must resort to studied political solutions that pour into The benefit of the people.

conflict areas

The central government in Baghdad and the Kurdistan region of Iraq has been fighting for years over several areas in governorates inhabited by a mixture of nationalities and sects: Arabs, Kurds, Turkmen, Muslims, and Christians. These areas are distributed between the governorates of Kirkuk and Nineveh in the north, Diyala in the center, and Wasit in the south.

Regarding the reactivation of the committee concerned with resolving the dispute over those areas and their repercussions, Hadi al-Salami, a member of Parliament independent of the Imtiad movement, believes that this article was found due to a regional conflict and partisan interests, far from the national interest and is subject to objection, indicating - at the same time - that the objection It is not based on a national standpoint, but in order to find legislation of a national nature based on citizenship.

Al-Salami said - in his speech to Al-Jazeera Net - that all experiences have proven that those who dominate the political scene are the cause of instability, and not the article itself despite reservations about it, indicating with regard to the issue of deportees and arrivals to those areas - during the previous regime and what followed - that the citizen The right to own property and live in any part of the homeland, and he has the right to stay in it or settle in another location if he was previously forced, stressing that talking about expatriates is no longer useful, as there was an Arab dispatch process before 2003, there is also a Kurdish dispatch process after that, As he says.

Regarding the government's seriousness in committing to activating the committee, Jaya Taymur, a member of the House of Representatives for the Patriotic Union of Kurdistan, says that the committee concerned with activating Article 140 was within the framework of the Sudanese government's approach and the state administration coalition agreement, and therefore non-implementation represents a breach of promises and generates bitterness among the Kurds, which leads to It may prompt them to request internationalization of the case and international arbitration, pointing out at the same time that the chances of applying the article will remain weak in light of the current circumstances and the prevailing political mentality.

And Taimur indicated - to Al-Jazeera Net - that the issue of Kirkuk represents a sensitive issue and a time bomb between the region and Baghdad, as it is liable to explode at any moment, so all parties must strive to find a just and implementable solution from a sincere national spirit far from sectarian and nationalist bias, and to do justice to those They were discriminated against by previous governments.

Meanwhile, the researcher in Iraqi political affairs, Muhammad Naanaa, believes that a governmental committee whose work is limited to preparation cannot fully resolve the issue of Article 140, specifically with regard to the most complex point in it, which is the issue of Kirkuk, indicating that the text of the article contains 3 executive obligations. Therefore, time does not allow a government that has committed itself to early elections within a year or a year and a half to conduct all of this.

Fears of war

On the other hand, the Turkmen parliamentarians, who are concentrated in Kirkuk, expressed yesterday, Saturday, their position rejecting the application of Article 140 of the Iraqi constitution, warning at the same time of the possibility of a "civil war" breaking out in the disputed Kirkuk governorate between Erbil and Baghdad in the event of proceeding with the procedures. application of this article.

This came in a joint press conference held by the head of the Turkmen Front, Hassan Turan, with representatives of the Turkmen parties and representatives of the component on Saturday in Baghdad.

Turan told Al-Jazeera Net that Article 140 had previously failed and will fail in the future to find sustainable solutions to the issue of the disputed areas, especially Kirkuk, considering that the article represents the point of view of the Kurdish side only.

e warned that seeking to hold a referendum on the fate of Kirkuk might lead to a war between the components of the province, based on what was confirmed by the United Nations in its report on the disputed areas in the years 2008-2009, he said.

Turan expressed his condemnation of the exclusion of the Turkmen component from the negotiations to form the Sudanese government, while the government program included items related to Kirkuk, where the Turkmen are concentrated, "which must be remedied

Legal opinion

For his part, legal expert Ali Al-Tamimi commented on the constitutional procedure to activate the committee concerned with the implementation of Article 140, by saying that Federal Court Decision 71 of 2019 confirmed the survival of the article and the need to implement it, as stipulated in the constitution by normalization, referendum, and determining the will of the voters, which the article required its application at the end of 2007.

Commenting on the existing controversy, Al-Tamimi believes - in his speech to Al-Jazeera Net - that the legal committee in this case is the most important, and that the solution is represented in parliament enacting a special law that dismantles and clarifies all the problems, indicating that there is no need for international intervention, given that the issue is internal and specific to Iraq alone. It can be resolved through constitutional means.

According to Article 140 of the Iraqi constitution, which was approved in 2005, the future of the disputed areas is determined in 3 stages, starting with normalization by returning non-native residents to their areas after financial compensation, then conducting a census of its population, to be followed by a popular referendum on its ownership of the government of Baghdad or Erbil, and this is done by Through the Supreme Committee for the implementation of the article

An economist reveals the feasibility of the central bank's dollar sales

link

Today, Sunday, economic expert Nasser Al-Kinani explained the reasons for determining the central bank’s sales to the private sector and private banks, and not to government banks.

Al-Kinani said in a statement to (Baghdad Today), that "the goal of the Central Bank's sales to the private sector is to import goods, which are made through merchants."

He explained that "these sales amount to 60 billion dollars annually," noting that " if 10% of the imported materials enter with these funds into the state treasury, then it is assumed that approximately 6 billion dollars enter the state treasury annually."

And he added, "But according to the tax figures that enter the country from imported goods, sales of hard currency should be much less than $60 billion."

And Al-Kinani considered, "The government must follow up the windows for selling the currency, because this matter has a great corruption aspect that affects economically the country."

He explained that "one of the manifestations of banking development in Iraq is that financial inclusion has increased by 33% over the past few years, and 2 million electronic wallets have been created, and the capital of banks has increased to 17.8 trillion dinars, compared to 159 trillion dinars, the value of assets."
And the head of the regional office of the Association of Private Banks stated that “deposits in banks rose to 96 trillion dinars, and loans to 80 trillion dinars, as banks granted 14 trillion to projects and the residential, agricultural and industrial sectors, and this is greatly reflected in the provision of job opportunities,” calling on the government to “ Providing a good business environment through many steps, including the possibility of depositing 10% of oil revenues in private banks to achieve a very high growth movement.

Regarding the Tamkeen initiatives, Al-Handal pointed out that “The Tamkeen Fund was established in 2014 under the management of the Central Bank of Iraq and the Association of Private Banks, and funded by donations from private banks on a monthly and annual basis. He stressed that "one of the priorities of the Central Bank of Iraq is that there be strong infrastructure, as all Iraqi banks have relied on paper and pen in the performance of their work during the past 15 years, and therefore there has become an urgent need to implement electronic systems because of the huge technical gap in this field." However, our banks are currently able to obtain modern technological systems, despite the need for new cadres and human resources.

And he indicated that "the Center for Banking Studies in the Central Bank was able to develop human resources in the banking sector through courses in the field of credit, auditing, money laundering, banking awareness and compliance," noting that "Iraq suffers from an unstable situation and a very difficult environment, and therefore the expansion of financial inclusion needs to be Extensive economic and investment studies.

a contentious article that appeared after 2008 serves the interest of the Kurdish component against the aspirations of the Arabs and Turkmens. The opinions of jurists differed regarding its effectiveness, but the only thing agreed upon is that its application will lead to “unimaginable” problems throughout the country.

Article 140 of the Iraqi constitution, which includes steps to settle the situation in the areas that have been affected by demographic changes between 1968 and 2003, so that this settlement takes place through normalization of conditions first and conducting a population census, as well as through conducting a referendum to determine the fate of the included areas, specifically the governorate of Kirkuk.

For his part, the leader of the Al-Fateh Alliance, Muhammad al-Bayati, confirmed that the implementation of Article 140 will lead to problems and unforeseen consequences in Kirkuk.

Al-Bayati said in an interview with Al-Maalouma, “The content of Article 140 is not new, and it was present in the temporary Iraqi state administration law, and it was not applied, then it was transferred to the constitution and was not applied at the end of 2007, because it is a contentious matter not among the components of Kirkuk, but rather all the Iraqi factions, and only the Kurds support it.” And it has goals.”

He adds, "jurists have different opinions regarding the effectiveness of Article 140, which was not applied during two periods after 2003, between those who say that it has lost its legal efficacy and those who say that there are other articles in the constitution that have not been implemented, but in general, that its application will lead to tensions and problems with ominous consequences in Kirkuk." ".

In turn, the former member of the House of Representatives, Wael Abdel Latif, stated that "the Kurds benefit most from the constitution."

In an interview followed by Al-Maalouma, he mentioned: "When we wrote the constitution and in the presence of the Kurds, it stipulated the refusal to divide Iraq," noting that "the region is not entitled to hold a referendum in accordance with the constitution."

And he points out, "Article 140 in the constitution was imposed by Masoud Barzani," stressing that "the constitution included 139 articles only after 2008. Article 140 was added."

The former deputy calls for "referring to Article 126 of the constitution to solve problems with the Kurds."

* The position of Arabs and Turkmen

Concerning the position of the Turkmen and the Arabs on Article 140 of the Iraqi constitution, there is a great divergence in the positions and opinions related to the Iraqi constitution, where the Arabs and the Turkmen made many objections to the attempts to implement this article, and the reason behind this matter is due to the fact that its application is considered a violation of the Iraqi constitution, and this is according Due to the expiration of the time limit set for application, which was in December of 2017, they also complain about the demographic change that occurred after 2003, which was for the Kurds.

In this regard, the former deputy and Turkmen leader, Jassem Muhammad al-Bayati, stressed the need not to implement Article 140.

Al-Bayati stated in a statement to Al-Maalouma, “It is necessary not to activate Article 140; Because its activation represents the beginning of the division of Kirkuk, and the removal of the Turkmen from the map of Iraq, as the experience of the presence of the Turkmen in Erbil and Kifri led to the migration of the Turkmen to Kirkuk or their transformation into Kurds, which represents a tragic experience for the Turkmen component.

And he points out, “The constitution must be amended without considering the Turkmen a minority or a quota in the parliament, in order to represent them optimally,” pointing out that “the number of Turkmen today reaches 3 million people, and therefore they are not minorities, and the constitution should consider them a third nationality.” ".

Al-Bayati stresses the need to "place an article in the constitution that gives the Turkmen the right to life, culture and presence in the state in proportion to their population percentage, as there are moves to add this article to the constitution according to the new amendments."

The role of the Kurds

The Kurds' position on Article 140 of the Iraqi constitution was positive and goes along with its implementation, as they find in this article the perfect solution to the conflict between the center and the region over the disputed areas, and an ideal solution for the province of Kirkuk, which is considered one of the provinces rich in oil, and this goes with the interests of the Kurds.

In addition, a member of the House of Representatives, Rafik al-Salihi, accused the Kurdistan region of trying to acquire huge sums of money by pressuring the approval of Article 140 of the Iraqi constitution, while confirming the existence of double financial assessment regarding the displaced in the south and the displaced from Kurdistan.

In an interview with Al-Maalouma Agency, Al-Salihi said, "Article 140 of the Iraqi constitution is part of it concerned with fairness to the displaced, who include the southern governorates such as Basra, Dhi Qar and Maysan, and not only the displaced in the Kurdistan region."

He points out that "the assessment stipulated that the diaspora in southern and central Iraq would receive only 10 million dinars, while the diaspora in the Kurdistan region would be allocated huge sums," considering that "this assessment is incorrect and unfair to the displaced in the south."

Al-Salhi concluded by saying, "The region is trying to pass this article to achieve personal interests, not in order to serve the displaced, given that the sums allocated to Kurdistan are large and huge, and often witness a waste of public money."

The Kurdistan region is always moving in a direction different from the legal articles and the rights of other components, especially the Turkmen, as it is the one who hit the decisions of the Federal Court “displaying the wall”, especially with regard to oil and gas and others, and resorts to the central government in the laws that serve it, and it is a region and a quasi-state when it relates to laws and decisions that contradict its purpose.

A government official confirmed, on Monday, that the exchange rates of the US dollar against the Iraqi dinar will decrease with the Central Bank's decision to increase the weekly share of banks, exchange and mediation companies, pointing out that the decline will have an impact next week.

The official told Shafaq News Agency, "The exchange rate of the dollar will decline in the coming days in the local markets, and its impact will be at the beginning of next week," noting that "the exchange companies will apply for their share of the dollar today, Monday, by depositing cash amounts in the safes of each company, and this will be done." Hand it over to the Central Bank, provided that this share of the dollar is delivered during the next week.

The official, who preferred not to mention his name and position, added that "the bank's decision came to reduce the gap between the central bank rate and the dollar price in the local markets or what is known as the black market," expecting "the dollar's decline to its previous levels, which were around 147 thousand dinars compared to 100 dinars." dollar".

Yesterday, Sunday, the Central Bank of Iraq decided to increase the share of banks, exchange and financial mediation companies from the dollar, in order to reduce the price of the dollar in the local markets, after its rise yesterday, Sunday, to more than 150 thousand dinars, compared to 100 dollars.

And the bank stopped 14 banks from entering the auction after the US sanctions that it imposed on these banks as a result of smuggling the currency.

It is noteworthy that the Central Bank sells dollars in an auction that it organizes daily to banks and mediation companies in order to finance foreign trade and finance the internal market in dollars, but many economists and politicians indicated the existence of corruption in the central bank’s sales by smuggling hard currency abroad without finding solutions to that over the years. these years.

The Iraqi Private Banks Association announced, on Monday, that the Central Bank's measures to increase the supply of dollars through its approved outlets will lead to a return of exchange rates to their rates quickly.

"The economic and political conditions and their repercussions negatively affect stability in the monetary system and the financial system, and thus this will lead to economic instability and market confusion," the association's advisor, Samir Al-Nusairi, said in a statement.

The exchange rate, which has remained stable since its adjustment to the new prices of finance, banks and the public.

He pointed out that "speculators took advantage of the decline in dollar sales in the window for selling foreign currency, which the central bank clarified in a statement last week that the reason is the application of a new electronic platform to control external transfers similar to the letters of guarantee platform currently implemented," noting that "given the lack of sufficient preparation For local banks, with the start of the trial application of the platform, part of the foreign transfers were postponed, which resulted in a decrease in the volume of sales of the foreign currency sale window.

And he emphasized that “another rumor is that the central bank will make a new change to the current price,” explaining that “the central bank has repeatedly announced that there is no intention to change the price at present and explained the negative effects of any change in the price on the national economy, trade exchanges, and local and foreign banking dealings with countries.” the scientist".

And he continued, “The exchange rate is determined by the central bank according to the effects and repercussions of the economic reality in a country like Iraq that suffers from challenges, repercussions, economic and financial crises, and a structural and systematic imbalance in managing the economy and money. Monetary, but this cannot be achieved without joint coordination with fiscal policy and other economic sectors, activating the real economy, diversifying sources of national income, and leaving the unilateral economy relying on oil as a main resource that constitutes 93% of the general budget revenues and 57% of the gross domestic product.

And he stressed that "those who criticize the central bank must be aware that its measures announced yesterday by increasing the supply of dollars through its approved outlets and banks will inevitably lead to the return of the price to its target rates inevitably and quickly."
