The Federal Supreme Court issued its decision No. 31 / federal / state order / 2022 on 10/17/2022 containing (issuing a state order to stop disbursing the amount allocated to the Prime Minister’s office under Cabinet Resolution No. (226) for the year 2022, which amounts to seventy billion dinars until the case is resolved) 228/Federal/2022 and obligating the Council of Ministers to abide by this and not to dispose of the amount until the aforementioned lawsuit is resolved).

This decision is one of the major strategic decisions in the history of the constitutional judiciary in Iraq, as the Federal Supreme Court was able to embody its basic function in accordance with the will of the people, the source of sovereignty, which is to protect the provisions of the constitution and protect rights and freedoms at the same time.

Perhaps we do not exaggerate in saying if we describe this decision as constituting a distinct judicial precedent, and an influential turning point in the judicial efforts made by the Iraqi judiciary related to combating the rampant financial corruption in the country.

Based on the foregoing, the importance of this decision is to devote the constitutional protection established for public funds in accordance with Article 27/First of the Constitution of the Republic of Iraq for the year 2005, as the Federal Supreme Court drew on the spirit and philosophy of the constitution in order to expand the place of control over the constitutionality of legislation to include consideration of cases that It arises from the application of federal laws and decisions issued by the Council of Ministers in accordance with the provisions of Article (93/Third) of the Constitution.

In addition, the importance of this decision stems from the huge amounts of money doubtful of the unconstitutionality of the Council of Ministers’ decision to spend them, which amount to (70) seventy billion Iraqi dinars, which would contribute to the consolidation of the principle of popular sovereignty, the principle of the rule of law, and the submission of all rulers and ruled to the provisions The law is in application of the principle of equality, as well as the application of the principle of the prohibition of immunization of any act from appeal to the judiciary, and the jurisdiction of the court to decide on accusations against the head and members of the executive authority [1] .

The court’s decision above comes in implementation of the judicial policy followed by the Iraqi judiciary in rebuilding the citizen’s confidence in the constitution and the law, which is a matter of contributing to the people’s support for the public authorities, as well as enhancing the confidence of the international community and organizations specialized in combating corruption in the efforts made by the public authorities to enhance transparency. and laying the foundations for good governance in Iraq.

In addition, the decision of the Federal Supreme Court came to perpetuate the jurisprudence and previous judicial principles that the court followed regarding the interpretation of the day-to-day care government [2] , which would confirm the absolute and binding authenticity of the court’s decisions in accordance with Article (94) of the Constitution.

While other images stem from the importance of the above decision in dedicating the court to its oversight over the constitutionality of the Emergency Support for Food Security and Development Law No. 2 of 2022, and then it can be said that this case is the first of its kind before the court regarding the extent to which the provisions of this law are constitutional. Which can be considered as a manifestation of the authority granted to the court in accordance with Article (46) of the internal system of the Federal Supreme Court No. (1) of 2022.

We do not fail to note that the Federal Supreme Court, with its aforementioned decision, has committed itself to the proper application of the principle of separation of powers and the principle of the supremacy of the Constitution [3]., by looking into the legitimacy of the decisions issued by the Council of Ministers, according to the principle of balance and constitutional engineering established by the founding fathers of the Iraqi constitution, which confirms the Court’s commitment to the spirit and philosophy of the constitution while exercising its powers specified for it in the constitution and complementary laws, without losing sight of the character The temporary decision of its decision and its connection with the outcome of the decisive decision, as well as the court’s confidence and assurance of the conditions of seriousness and urgency stipulated in Article 144 of the Civil Procedures Law, and the provisions of Article (39) of the internal system of the Federal Supreme Court, without neglecting a constitutional matching between the decision Cabinet No. (226) of 2022 on the one hand, and the proper application of the Cabinet’s competence to issue decisions for the purpose of facilitating the implementation of the law in accordance with Article (80/third) of the Constitution and the provisions of the Financial Management Law No. (6) of 2019.

In this way, we commend the Iraqi judiciary in general and the Federal Supreme Court in particular for this pioneering role in protecting public money in accordance with the provisions of the Constitution, as it is the basis and essence of protecting public rights and freedoms in the Constitution. We call on the court to expand the scope of its oversight and to take firm steps in exercising its authority by addressing the unconstitutionality of regulations and other decisions similar to the case in the case of the state order above.

Shafak News Agency followed the data and tables issued by the Ministry of Finance in the current month of October for the accounts of last August, which indicated that oil is still the main resource for Iraq's general budget, reaching 96%, which is the same percentage for the past five months, which indicates that the rentier economy is The basis for Iraq's general budget.

Through the financial tables, it is shown that the total oil revenues for the month of August amounted to 103 trillion and 669 billion and 500 million and 471 thousand and 848 dinars, which represents 96% of the total revenues, while the total non-oil revenues amounted to 4 trillion and 504 billion and 798 million and 551 thousand and 744 dinars, which is It constitutes 4% of the total revenues, while the total oil and non-oil revenues amounted to 108 trillion and 174 billion and 299 million and 23 thousand and 592 dinars, which is 92.86% higher than the same period last year 2021, which amounted to 56 trillion and 465 billion and 687 million dinars as a result of high oil prices .

According to the finance report, the revenues for the month of August came from current revenues, which amounted to 108 trillion and 126 billion and 295 million and 878 thousand and 446 dinars, and also came from capital revenues, which amounted to 48 billion and 3 million and 145 thousand and 147 dinars.

for his part; Financial expert Hilal Al-Tahan confirmed in an interview with Shafaq News that "the high percentage of the oil sector's contribution to the budget is alarming, which means that the state has not tried or is trying to diversify its economy, which is still rentier, which will make international oil prices control Iraq's general budget."

He added that "all the major oil countries in the Organization of Petroleum Exporting Countries tended to diversify their economy, taking advantage of the large revenues that came through the oil sector, realizing the importance of this after the countries of the world sought to reduce dependence on fossil fuels and move towards clean energy."  

He pointed out that "striving to get rid of the rentier economy requires a serious stand by decision-makers in the state through several important factors, which are the development of industry and agriculture, activating the private sector, attracting foreign investments, reducing imports, and activating laws that are in the interest of protecting the product and supporting local production." 

The Prime Minister's Adviser for Financial Affairs, Mazhar Muhammad Salih, had confirmed in March 2021 in an interview with Shafaq News Agency that the reasons for the economy remaining rentier are due to wars and the imposition of sieges during the past era and the political conflicts we are witnessing today, which led to the dispersal of economic resources.

And he continued, "Al-Sudani stands at the same distance from all political blocs by following a special mechanism in selecting candidates and submitting them to a special committee for evaluation."

The "ministerial stew" is not ready

However, Al-Sudani’s statement today issued indirect signs that the “ministerial recipe” has not yet matured, amid information that several disagreements arose between parties and political parties, over the distribution of positions and ministerial portfolios.

It is well known that the formation of governments in a country like Iraq, with multiple sects, parties and loyalties sometimes, in which armed parties and factions dispute power, is not an easy task, and it often takes place through rounds of compromises.

 

It is noteworthy that Al-Sudani pledged last week to present a strong government formation capable of building the country, after President Abdel Latif Rashid assigned him to that task.

 

Meanwhile, the leader of the Sadrist movement, Muqtada al-Sadr, launched a scathing criticism against him, saying that Al-Sudani had begun to form a "coalition government of militia dependence." On the 15th of this month, he warned against the participation of any of his supporters in the government formation supported by the coordination framework, Al-Sadr's archenemy.

Crisis rages

On October 13, Parliament elected Rashid as president, after months of procrastination and conflicts, and the resignation of Sadr's deputies.

 

Since last year, Iraq has witnessed a raging political crisis between the Sadrist movement and the "Coordination Framework" (which includes the State of Law coalition led by Nuri al-Maliki, the Al-Fateh Alliance, and other pro-Iran factions), which, until last week, prevented the election of a president or the formation of a government.

The Iraqis will long regret Mustafa Al-Kazemi’s exit from the prime minister’s position, especially since the man was looking forward to returning Iraq to the Iraqis, despite the objection of those he called “whales” to every step taken by the government. He was working for this in parallel with seeking to reposition Iraq in the region as a major player in it and not just a follower of the "Islamic Republic" in Iran.

Iraq was never required to be hostile to Iran, regardless of the nature of the regime in Tehran. Likewise, at the same time, Iraq cannot dispense with its Arab depth, especially its Gulf depth. This is indeed a difficult equation, and it appears every day that the Iranian "Islamic Republic" party in Iraq cannot accept it in any way.

Al-Kazemi was not allowed to complete his mission, even though he was among the few Iraqis who knew the region and the world and what was going on in them. He knew that oil is not everything and that human wealth remains the most important. He gave evidence of this that countries such as Singapore and Taiwan have become prosperous countries with huge financial reserves, despite their lack of natural resources. Such rich countries “import even the grain,” as Al-Kazemi put it.

 

Al-Kazemi's speech at what could be the last session of the Council of Ministers headed by him was very clear. It was a scientific dissection of the situation faced by the resigned Iraqi prime minister, relying on "patience and silence." Most important of all, for the first time since the establishment of a new regime in Iraq, after 2003, there are those who adopt the language of numbers. The language of numbers has withdrawn from Mustafa Al-Kazemi himself, who revealed that he had been exposed to three assassination attempts, the last of which was in November 2021 when his house in Baghdad was attacked by drones.

The language of numbers also affected the improvement of Iraq's economic situation while in power. The reserves of hard currencies rose to 85 billion dollars, and the gold stock of the Iraqi state rose to 134 tons. Al-Kazemi's government, especially through the Ministry of Finance that was headed by Ali Allawi, wanted to create an opportunity of hope for the Iraqis. In the beginning and in the end, it is required to fight rampant corruption.

Al-Kazemi was more than clear when he said that he had been alerted early to what was happening in the field of tax revenues seizing since 2021. It has now turned out that the Iraqi militia banking companies have seized two and a half billion dollars in tax revenues in a twisted way. In the future it may turn out that the amount is much higher...

It is clear that Mustafa Al-Kazemi knows exactly what is going on in Iraq. That is why he said: “A year ago, his government presented all documents, evidence and clues that contribute to revealing the truth and knowing the aggressors on public money,” commenting on the ongoing investigations into the theft of $2.5 billion in tax revenues.

It has become clear that there is no place in Iraq for people like Al-Kazemi. The man did what he could do. Save what can be saved. All that can be said is that Iraq has entered a new phase in light of Iran's ability to re-establish its hand on Iraq. Iran has not left Iraq since 2003, but what is new in the matter is that the bet on Shiite leader Muqtada, who won the October 2021 elections, was not a proper bet.

It simply turns out that Muqtada al-Sadr does not know what he wants. He offended everyone who allied himself with him before he offended himself, the moment he asked his deputies to resign. He left the Iraqi parliament in the custody of the coordinating framework, that is, the parties loyal to the “Islamic Republic.”

Al-Kazemi took note of what happened, as well as the Kurdish leader Masoud Barzani, who made a deal that brought Abdul Latif Rashid to the position of President of the Republic. He did this in order to prevent the re-election of Barham Salih as president. There is a blacksmith made between the two men. On the other hand, Barzani accepted that Muhammad Shia Al-Sudani, the candidate for the coordination framework, would be prime minister to succeed Al-Kazemi.

It cannot be said that Al-Sudani is the man of Nuri al-Maliki, who does not hide his affiliation with Iran. Rather, he is outbidding the Iranian regime itself, but the new prime minister is not able to completely break out of al-Maliki's mantle.

With Mustafa Al-Kazemi out of power, if Al-Sudani can form his government, Iraq will be different. There will be a missed opportunity for Iraq and the Iraqis.

But Al-Kazemi, who did not hide his support for Al-Sudani, wishing him success, will remain the Iraqi man of the future. We are talking here about Al-Kazemi's model as an Iraqi politician who is looking for a country that has a role of its own that is not affiliated with Iran.

Does the Iraqi regime in place since 2003 allow that? Can a society that produces leaders like Muqtada al-Sadr or Nouri al-Maliki and many other leaders of sectarian militias affiliated with the “Popular Mobilization” develop itself?

Much in Iraq will depend on what happens in Iran, where the future of the regime is now on the cards. There is a real popular revolution in Iran that is led by women and the younger generation. This revolution against the regime includes all Iranian regions and peoples. If this revolution, which the Revolutionary Guards may be able to suppress, proves anything, it proves that there is no viable model that the Islamic Republic under the leadership of the Leader can present, neither inside Iran nor outside it. The Iranian regime has nothing to export other than the culture of death and misery...

A question remains that can be asked in light of what the Al-Kazemi government has been able to achieve in terms of relative success in very complex circumstances. The question: Where are the live forces in Iraq, and is there a way for them to play their role in the event of a major change in Iran?

He added, "The loan amount reached 100 million dinars without interest and with a repayment period of 15 years," noting that "it formed a great support from the Central Bank for the purpose of revitalizing the housing sector and controlling the rise in real estate prices."

Al-Nusairi continued, "The issue of high real estate prices is linked to the internal economic situation, economic stagnation, and the failure to activate other economic sectors," noting that "the actual need for housing units is up to (3.5) million housing units, and this large number requires large sums and exceptional efforts by the relevant ministries and the National Investment Authority.
