The first reading in the Iraqi parliament of the Federal Court's law sparked a wide debate within the political, judicial and civil circles alike and warnings of the possibility of a "religious state". 

Most of the debates and dissatisfaction with the law focused on the paragraph on the addition of four scholars of Islamic jurisprudence to the membership of the 13-member court, including the president and his deputy. Most of the concerns of those opposed to the new law focused on the possibility that Iraq could become a "religious state" with the weight of the four jurists, or that the federal court would turn into a "council to diagnose the interests of the regime" along the lines of the Iranian model. 

Perhaps the biggest concern was that the first version of the law, submitted to Parliament in 2015, included only two jurists within the court, but the new version of the law raised their representation ceiling to four. 

The Federal Court is one of the six main judicial authorities in Iraq, whose main functions are to monitor the constitutionality of laws, to interpret the provisions of the Constitution, to adjudicate cases arising from the application of federal laws and to endorse the final results of the general elections. 

"The law in its current form is very dangerous," said Saeb Khaddar, a member of the House's legal committee. Khaddar told Asharq Al-Awsat that "it is surprising that voting powers are granted to jurists, and they are supposed to be given the right to consult only."
